Election law has legal flaws: official

KABUL) members on Wednesday said there were some legal problems in the newly-enacted law concerning the structure, duties and powers of the two poll panels.

The draft law, having five chapters and 35 articles, was signed by the president on July 7, 2013. Days earlier, the measure was approved by both houses of parliament after lengthy debates.

IEC deputy head Abdul Khaliq Hussaini told reporters on Wednesday parliamentarians had approved the law, keeping in view their own interests, instead of the national interest.

 “Practically, we see can parliamentarians collecting forms from a committee in an attempt to be chosen as commissioners,” he said, urging the legislature to approve or reject the draft law in totality.

According to Article 109 of the constitution, the parliament in the last year of its tenure could not pass or amend the election law, Hussaini argued.

Similarly, district and provincial council representatives in the Meshrano Jirga had also completed their constitutional tenure and could not pass any law, he said.

Current commissioners are familiar with their work while the newly-appointed ones would be unable to properly handle election activities in the next few months, he believed.

The committee of selecting candidates for the councils of IEC and Electoral Complaint Commission (ECC) was also against the constitution because it was the president’s authority to form the panels, he concluded.
